Mental Health and the Law in New York
At Littman Krooks LLP, we recognize that it takes careful understanding and work to assist a loved one with a mental health condition. Our attorneys have experience assisting clients in the handling of cases initiated pursuant to the New York State Mental Hygiene Law (MHL). We handle these cases with compassion and experience. We are keenly aware of the complex and difficult circumstances that surround seeking proper care for those with mental health conditions. We work with families to assist in providing resources, including referral to psychiatrics and other appropriate specialists.
Using a careful team approach, we seek appropriate outcomes and endeavor to seek the least restrictive alternative. If needed and appropriate, we offer assistance with petitions related to Mental Hygiene Law Article 9, including involuntary commitment proceedings, retention hearings or Assisted Outpatient Treatment (known as AOT) or MHL Article 81, which is one of the guardianship statutes in New York. These matters are under the jurisdiction of the New York State Supreme Court, where our experienced attorneys work diligently toward for the best outcome.
Our firm assists clients with understanding the entirety of the proceeding including advocacy, and , if needed, the petition process, court hearing and final determination. Our firm services include representation of skilled nursing facilities, community guardians, as well as families and individuals with mental health and substance abuse issues. We also help families prepare for these types of situations with advance directives and powers of attorney.
Individuals of any age can experience a mental health condition, and, in our special education practice, we focus on ensuring that children and teens with mental health conditions receive appropriate evaluations, placement and services. Our highly experienced attorneys can also provide advocacy for students experiencing mental health crisis in college who need intervention or support.
