This CLE webinar for elder law counsel will explore issues surrounding continuing care retirement communities (CCRCs). The panel will review the types of CCRC contracts and levels of care available and provide guidance to counsel for clients in understanding and negotiating the best CCRC for their needs and financial circumstances. CCRCs are growing in number, transitioning from small communities run by religious or nonprofit organizations to large, upscale, for-profit developments with complex financial structures. Regulation of CCRCs varies widely from state to state, and facilities and care options vary widely among CCRCs.

Seniors choosing to move into a CCRC must be prepared to make a substantial financial commitment—hundreds of thousands or even millions of dollars. Elder law counsel have a vital role to play in helping senior clients navigate this critical transition, from negotiating complicated residence and care agreements, to assessing a CCRC’s financial stability. Counsel must also thoroughly review contracts to protect clients against involuntary transfers and unwanted guardianship petitions.
